California Consumer Privacy Act (CCPA)

What is CCPA?

The California Consumer Privacy Act (CCPA) is the first comprehensive privacy law in the United States. It provides a variety of privacy rights to California consumers. Businesses regulated by the CCPA will have a number of obligations to those consumers, including disclosures, General Data Protection Regulation (GDPR)-like consumer data subject rights (DSRs), an 'opt-out' for certain data transfers, and an 'opt-in' requirement for minors.

What is considered personal data under CCPA?

  • Identifiers
  • Characteristics of protected classifications under California or federal law
  • Business information
  • Biometric information
  • Internet or other electronic network activity information
  • Geolocation data
  • Audio, electronic, visual, thermal, olfactory or similar information
  • Expertise or employment-related information
  • Educational information, personally identifiable information that is not publicly available as defined by relevant education laws
  • Inferences drawn from the above relevant information to create a profile about the consumer reflecting information on the consumer's preferences, characteristics, psychological trends, tendencies, behaviors, attitudes, intelligence, abilities and talents

What are the rights of consumers under CCPA?

  • The right to know about the personal information a business collects about them and how it is used and shared
  • The right to delete personal information collected from them (with some exceptions)
  • The right to opt-out of the sale of their personal information
  • The right to non-discrimination for exercising their CCPA rights

What does it mean for a B2B organization to be CCPA compliant?

  • Inform consumers about the category and purpose of collection prior to information collection
  • Detailed disclosure in the privacy policy of the source, business purpose and categories of personal information collected, including how these categories of information are sold or transferred to other entities
  • Give consumers the right to access, erasure, and port certain parts of the personal information you have collected
  • Enable controls that allow consumers to opt out of the "sale" of consumer data. However, certain transfers (eg to service providers) are still permitted
  • For minors under the age of 16, enable an opt-in process so that minors' personal information may not be sold without actively opting in to the sale
  • Ensure that consumers are not discriminated against for exercising any of their rights under CCPA
