California Consumer Privacy Act (CCPA)

What is CCPA?

The California Consumer Privacy Act (CCPA) is the first comprehensive legislation on consumer privacy protection and data security in the United States. It provides a variety of privacy rights for California consumers. Enterprises regulated under the CCPA shall undertake a series of obligations to consumers, including disclosure, data subject request (DSR) similar to the General Data Protection Regulation (GDPR), "opt-out rights" for data transfers, and "opt-in rights" for minors (under 16 years of age), etc. This Notice applies only to "consumers" as defined in the CCPA.

What is the personal information regulated by the CCPA?

  • Identification
  • Characteristics of classifications protected under California or federal law
  • Business Information
  • Biometric Information
  • Information on Internet or other electronic network activities
  • Geographic Location Data
  • Audio, electronic, visual, thermal, olfactory or similar information
  • Professional knowledge or information related to employment
  • Educational information, personally identifiable information that is not publicly available as defined by relevant education laws
  • Inferences drawn from the above relevant information used to create profiles about consumers that reflect their preferences, characteristics, psychological trends, tendencies, behaviors, attitudes, intelligence, abilities, talents, etc.

What are the consumer rights under the CCPA?

  • The right to learn about the personal information that companies collect from consumers and how they use and share such information
  • The right to require companies to delete the personal information they collect from consumers (with some specific exceptions)
  • The right to choose not to sell their personal information
  • Companies must not discriminate against consumers for exercising their CCPA-related rights

What does it mean for B2B organizations to comply with the CCPA?

  • 1. Inform the consumer of the type and purpose of the collection before the information is collected.
  • 2. Disclose in detail in the Privacy Policy the sources, business purposes and classifications of personal information collected, including how information of such category may be sold or transferred to other entities.
  • 3. Give consumers the right to access, delete, and download certain personal information collected by the companies.
  • 4. Provide an "opt-out" control that allows consumers to opt out of the sale of personal information. However, certain transfers (e.g., to service providers) are still allowed.
  • 5. For minors under the age of 16, an "opt-in" control is provided so that the minors' personal information is not sold if they have not actively opted in to be sold.
  • 6. Ensure that consumers are not discriminated against for exercising any of their rights under the CCPA.
